If you finalize your divorce before you file for bankruptcy, you will have to file for bankruptcy separately. By waiting to complete your divorce, you can file bankruptcy together. Does it matter? Yes.

By filing for bankruptcy first, your debts may be discharged and become a nonissue during your divorce. This means simpler property division during divorce or, in other terms: a quicker, less argumentative and, thus, cheaper divorce. Furthermore, it costs the same amount of money to file for bankruptcy together as it does to file individually except for the attorney fees, which are greater if you have two cases versus just one.
