What is a Garnishment?

In Michigan, creditors such as credit card companies and hospitals can garnish your Social Security checks, paychecks, and savings and checking accounts to pay your debts. A wage garnishment, the most common form of garnishment, is good for 90 days. A bank account garnishment is a one-time event.

If you receive notice of a garnishment, you can stop it by filing Chapter 7 or Chapter 13 bankruptcy. However, filing bankruptcy only makes sense if you have a significant amount of debt. It's important to receive a lawyer's advice before you take such a serious step to fix your finances.

Filing bankruptcy will also stop all forms of creditor harassment. Once you file bankruptcy, your creditors can no longer call you.

Can I Get Garnished Money Back?

If more than $600 has been taken from you within 90 days of your bankruptcy filing, your lawyer can get the money back. However, you have to act promptly.
